These Terms and Conditions form a legally binding agreement between you (the “Customer”) and Abby Fine Art (“we”, “our”, or “us”). By using our website or purchasing any commissioned artwork, prints, or services from Abby Fine Art, you agree to the following Terms.

Please read them carefully before placing an order.

1. Interpretation

Artwork
A physical or digital artwork created by Abby Fine Art. This includes original artworks and custom commissions.

Customer
Any individual who places an order or uses the services offered by Abby Fine Art.

Order
A customer’s request for an artwork after agreeing to the listed pricing and providing the needed reference materials.

Original Artwork
A one-of-a-kind artwork produced by Abby Fine Art.

Print
A reproduction of an original artwork (only applicable if prints are available).

Website

2. Eligibility

You may use the website and purchase artwork in compliance with these Terms and all applicable laws.
Parents or legal guardians are responsible for purchases made by minors.

By placing an order, you confirm that you are authorised to make the purchase and provide correct information.

3. Commission Process

By placing a commission order, you agree to the following:

• You are responsible for providing clear reference photos and instructions.

• Artwork will be completed according to the size, medium (pastels), number of subjects, and details agreed upon.

• Any changes requested after work has begun may affect pricing or cannot be made, depending on the stage of the artwork.

• A deposit may be required to secure your place on the waiting list.

• Remaining payment is due before delivery or pickup.

We reserve the right to decline an order if references are unclear, inappropriate, unsafe, or impossible to work from.

4. Prices

Prices vary depending on the size of the artwork, complexity, and number of subjects.

Prices listed on the website or communicated directly are subject to change at any time.
Shipping costs, if applicable, will be provided before final payment.

If a pricing error occurs, the Customer will be notified and can either continue with the corrected price or cancel the order with a full refund.

5. Payments

Accepted payment methods include those listed by Abby Fine Art at the time of purchase (e.g., bank transfer, PayPal, etc.).

• Deposits (if required) are non-refundable unless we cancel the order.

• Final payment must be received before the artwork is shipped or delivered.

• An electronic receipt will be sent once payment is processed.

If a payment fails or is reversed, the order will be paused until a valid payment is provided.

6. Shipping & Delivery

Shipping is available to the regions listed by Abby Fine Art or as discussed with the Customer.

Delivery timeframes vary depending on:

• commission queue

• artwork size

• shipping delays outside our control

We are not responsible for damage caused during transit, but we will help guide you through lodging a claim with the courier if needed.

7. Artwork Description & Colour Accuracy

We aim to describe artworks accurately. However:

• Real-life colours may vary slightly from what appears on your screen.

• Pastel textures and details may look different depending on lighting or device settings.

Please review your references and descriptions carefully before confirming your order.

8. Copyright & Usage Rights

All artworks created by Abby Fine Art remain the intellectual property of the artist, even after purchase.

You may:

• Display the artwork in your home or gift it to someone.

You may NOT:

• Reproduce, copy, scan, sell, or distribute the artwork in any form.

• Use the artwork commercially without written permission.

• Edit or alter digital files (if provided).

Abby Fine Art retains the right to:

• Photograph the artwork for portfolio use

• Share photos of the artwork on social media or the website
  Unless the customer requests privacy before work begins.

9. Refunds & Cancellations

Because each commissioned artwork is custom-made:

• Refunds are not available once the artwork has begun.

• Deposits (if applicable) are non-refund­able.

If Abby Fine Art must cancel an order for any reason, a full refund will be issued.

10. Customer Conduct

You agree not to:

• Provide offensive, harmful, or unsafe reference images

• Engage in abusive behaviour toward the artist

• Use the website or artwork for illegal purposes

We reserve the right to refuse service for inappropriate conduct or violation of these Terms.

11. Changes to Terms

We may update these Terms at any time. Continued use of the website or commissioning artwork indicates acceptance of the revised Terms.

12. Personal Information

Any personal information you provide (such as your name, email, address, or photos of your pet) will be used only for completing your order.
We do not sell or share your information.

13. Disputes

Any disputes arising from orders, payments, or these Terms should first be addressed directly with Abby Fine Art.

If not resolved, the matter will be handled under applicable Australian consumer law.
